Arrested for Being at the Wrong Place at the Wrong Time? What to Do

If you are arrested simply for being near where the police claim a crime took place, what you do in the first moments can shape the entire case. Keep three things in mind.

  1. Invoke your right to a lawyer, and remain silent. Explaining your way out can be used against you later.

  2. Do not sign any document. Not a “consent to search,” a waiver, or a statement, without counsel.

  3. Memorialize everything. Recall what the police claim they personally saw you do, because this becomes decisive in court.
